Many laws are currently in place assuring an employee’s rights within their workplace. Some examples include the right to workplace safety, the right to make workers’ compensation claims, or the right to overtime payment. Other laws protect employees’ rights to share information about their employers’ malfeasance in certain circumstances (or “whistleblowing”). Utilizing ones’ rights or issuing complaints, whether internally or externally, is legally protected. Despite this, employees who do so are often unfairly retaliated against by their employers, through what is referred to as “retaliatory acts.” These can include termination, failure to promote, demotions, suspensions, and pay decreases. Retaliation can also include harassment or bullying designed to persuade other employees from making complaints or taking action against an employer. We help clients pursue cases against employers for this sort of illegal retaliation.
